1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from www.actomarkt.com to consumers (§ 13 BGB).

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

2. Contractual partner

3. Offer and conclusion of contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to order. Errors excepted.

3.2 By clicking the [order for a fee] button, you place a binding order for the goods listed on the order page. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

You can revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter, fax, email). The cancellation period is 14 days from the day on which you or a third party named by you who is not the carrier took possession of the goods.
In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the cancellation form enclosed with the shipment or use it here , although this is not mandatory. In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period has expired. Consequences of revocation
If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us to be repaid immediately and no later than fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will we charge you any fees for the return. We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier. You must return or hand over the goods to us immediately and in any case no later than 14 days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the deadline of 14 days has expired. You bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

– for the delivery of goods that are manufactured according to customer specifications or
– are clearly tailored to personal needs or
– which are not suitable for return due to their nature.

5. Prices and shipping costs

6. Delivery

6.1 Delivery within Germany and the EU takes place with DHL.

6.2 Information about delivery times can be found on the respective product page.

7. Payment

End customers / regular customers / trading partners can pay via PayPal, advance payment, cash on delivery, invoice and cash upon collection. Details can be found under payment conditions.
Authorities, public, non-profit, charitable and church institutions can pay via invoice with a payment term of up to 60 days.
Wholesalers and resellers receive a binding, individual distributor price list from us.

Once you have found the product you want, you can add it to your shopping cart without obligation by clicking on the button (Add to shopping cart). You can view the contents of the shopping cart at any time without obligation by clicking on the button (shopping cart). You can remove the products from the shopping cart at any time by clicking the (delete) button. If you want to buy the products in the shopping cart, click the button (checkout). Please then enter your details. The mandatory information is marked with a *. Registration is not required except for commercial customers with a business license. Your data is transmitted encrypted. After entering your data and selecting the payment method, you will be taken to the order page using the button (check entry), where you can check your entries again. If you have created a customer account, you can view your customer data at any time under 'Customer Login'. The order details and the terms and conditions will be sent to you by email. After the order has been completed, the contract text is no longer accessible via the Internet for security reasons.
